The Victorian Government has implemented a Sick Pay Guarantee for those that are sick and for carers, who are either casual or contract workers.

The Victorian Government’s Sick Pay Guarantee may pay up to 38 hours of personal and/or carer’s pay per year to eligible casual and contract workers. This means that workers who are not already entitled to any form of paid leave, may be eligible for the Sick Pay Guarantee if they are ill or caring for someone.

This two-year pilot program came into effect on 14th March 2022 and is being fully funded by the Victorian Government. Workers will be paid at the National Minimum Wage as it was on the date the claim was made.

Eligibility requirements:

  • 15 years or older
  • Physically work in Victoria
  • Have the right to work in Victoria
  • Work an average 7.6 hours per week or more in an eligible job
  • Don’t have access to sick and carer’s leave entitlements at any job

Eligible jobs:

  • Hospitality
  • Food trades or food preparation
  • Supermarkets
  • Retail
  • Sales
  • Aged and disability care
  • Cleaning and laundry
  • Security

Workers are required to sign themselves up before they can claim the Sick Pay Guarantee.

Employers are not required to be involved in the applications for the Sick Pay Guarantee, unless:

  • your employee requests evidence of employment if they do not already have it, and
  • the Department of Jobs, Precincts and Regions may contact you as an employer to verify a worker’s application or claim as part of a randomised audit.
